Terms of Service

These Terms of Service ("Terms") govern your use of DemoScan. By creating an account or using the service, you agree to these Terms.

What DemoScan Is

DemoScan is an AI-powered demolition takeoff tool. You upload architectural plans; DemoScan extracts itemized demolition quantities for your review; you edit and export the results.

DemoScan is a tool to assist estimation. Final takeoff values are your responsibility. You are responsible for reviewing every line item and verifying accuracy before using DemoScan's output for bidding, contracting, or any other business purpose. AI analysis is not a substitute for professional judgment.

Your Account

You are responsible for keeping your account credentials secure. You may not share your account with other people unless your subscription plan explicitly allows it.

You are responsible for all activity under your account. If you suspect your account has been compromised, contact us immediately.

Acceptable Use

You may not:

  • Reverse engineer, decompile, or attempt to extract the source code of DemoScan
  • Resell DemoScan access to third parties
  • Use DemoScan to process content you do not have the legal right to process
  • Use DemoScan in a way that violates any applicable law
  • Attempt to bypass usage limits, trial expirations, or security measures

We reserve the right to suspend or terminate accounts that violate these terms.

Subscriptions and Billing

DemoScan is a subscription service billed monthly.

Auto-renewal

Subscriptions automatically renew at the end of each billing period. You can cancel at any time from your account settings. If you cancel, your subscription remains active until the end of the current billing period, then is not renewed.

California residents

Per California Business and Professions Code Section 17600, you may cancel your subscription at any time. To cancel, log in to your account and use the cancellation option. You will receive a confirmation email after cancellation.

Refunds

We do not offer prorated refunds for partial billing periods.

Your Content

You retain all rights to the plans, takeoffs, and data you upload to DemoScan. We do not claim ownership of your content.

You grant DemoScan a limited license to store, process, and display your content solely for the purpose of providing the service to you. This license ends when you delete your content or your account.

You warrant that you have the legal right to upload any plans or documents submitted to DemoScan. Uploaded plans remain the intellectual property of their authors. DemoScan's license to process your content is limited strictly to generating demolition takeoffs. No other use is made of uploaded content.

Dispute Resolution

Any dispute arising from these Terms or your use of DemoScan will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for intellectual property violations or unauthorized access to the service.

AI Accuracy Disclaimer

DemoScan uses AI to analyze plans and generate takeoff line items. AI output may contain errors, omissions, or misclassifications. You are required to review every line item before relying on DemoScan's output.

DemoScan is not responsible for bidding losses, contracting errors, or financial damages arising from reliance on AI-generated output. Your professional judgment supersedes DemoScan's analysis.

Service Availability

We strive to keep DemoScan available and performant. We do not guarantee uninterrupted service. We may perform maintenance, updates, or fixes that result in brief downtime.

Limitation of Liability

To the maximum extent permitted by law, DemoScan and its operator are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use of DemoScan's output
  • Damages exceeding the amount you paid for the service in the 12 months preceding the claim

Governing Law

These Terms are governed by the laws of the State of California. Any dispute arising from these Terms or your use of DemoScan will be resolved in the state or federal courts located in California.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email before the changes take effect. Continued use of DemoScan after changes take effect constitutes acceptance.
